Below you will find a general version of our contract.  After confirming your booking you will be sent a confirmed contract with your specific dates and information filled in.  Please be aware, that when you submit your signature and agreement on our booking form, you are agreeing to this contract and will be legally bound by it.

 

This lease, entered into this {Booking Date}, by and between Red River Gorge KY Retreats, Owner (“Owner”) and {Full Name}, “Renter” for the property located PROPERTY ADDRESS (“Property”).

  1. TERM: The term of the lease shall begin on the arrival date of: {Start Date} and end on the departure date of {End Date} for {Number of Nights} number of nights. The property will be ready for occupancy no earlier than 11am on the arrival date and must be vacated no later than 3pm on the departure date.
  2. RENT: The rent is {Total Amount} including but not limited to a housekeeping fee, pet fees, security deposit and any other fees are payable as follows:
  3. PAYMENTS: The following payments are due at time of reservation:
    1. The full reservation fee (including any and all fees, taxes, deposits, etc.) of {Total Amount}.
    2. In consideration of your tenancy agreement, a fully refundable security deposit fee in the amount of {Security Deposit} is hereby acknowledged. This deposit shall be returned to you no later than 7 days following the termination of the lease on {End Date}.  In the event that a determination is made that any stipulated house rules have been violated, or damage to the property or its contents has transpired during the lease term, the security deposit fee shall be utilized for the purpose of compensating for said damages. Furthermore, additional charges may be levied upon you, the customer, at our discretion, to cover any further associated expenses.
  4. LIMITED OCCUPANCY: Occupancy is limited to a maximum indicated on in the description of the property. If Owner concludes that this policy has been breeched, the Owner reserves the right to expel the entire party with no refund.
  5. NON-DISTURBANCE CLAUSE: Renter and their guests shall not disturb, annoy, endanger (fireworks) or inconvenience neighbors nor use the premises for any unlawful purposes.
  6. CARE OF PREMISES/DAMAGES: NO PETS ALLOWED. NO SMOKING PERMITTED IN HOUSE. Automatic eviction plus forfeit of deposit and rent if violated. Renter agrees to pay Owner for any damages to furnishings, household items or pool/hot tub that occur as a result of Renter’s occupancy. This will include payment of any additional cleaning charges over $100.00 incurred due to Renter’s occupancy.
  7. OWNERS RIGHTS: Renter agrees that if the conditions and limitations set forth herein are not met, Owner shall have the right to cancel this agreement and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Renter has vacated the Property. All monies paid by Renter shall be forfeited as liquidated damages.
  8. INDEMNITY CLAUSE: Renter herby agrees to Indemnify and hold Owner harmless from any and all claims including those of third parties, arising out of or in any way related to Renter’s use of Property or the items of personal property provided therein. Renter assumes all risk of injury or other losses relating to any recreational activities including use of the private swimming pool on the Property and will hold Owner harmless with respect thereto.
  9. NO SUBLETTING: Renter may not sublet or assign this lease for all or any part of the premises without prior written consent of the Owner.
  10. REPAIRS AND MAINTENANCE: The Property is rented with the Owner’s furniture and household furnishings.  Owner shall not be responsible for providing additional furnishings or equipment not presently available in Property.  Renter will report any maintenance issues immediately to the Owner.  Owner will make every effort to repair and/or replace any equipment that is not working properly, but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures.
  11. CANCELLATIONS
    Cancel by
    Cancel by 48 hours after booking and you’ll get a full refund: Get back 100% of what you paid.
    Cancel 7 days before {Start Date} and you will receive 50% of what was paid for the reservation back.
    {Start Date} no refund.
  12. PARKING: follow all parking guidelines outlined in our guidebook/email communications.

Renter and Owner, by signing this Rental Agreement, acknowledge that they will comply with the terms of this agreement and each assumes the responsibility for the obligations set forth herein.

Renter acknowledges receipt of the House Rules (will be sent 7 days prior to {Start Date}).

Renter acknowledges that they have read, accept, and agree to the terms set forth.
